Quick summary: These Terms govern your personal use of the Website and retail purchases made through it. 1.1 Agreement. By accessing the Website, creating an account, or placing an order, you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Website.

1.2 Personal use; age. The Website is intended for individual consumers for personal, non-commercial use. You must be at least 21 years old to purchase hemp-derived products from us.

1.3 Related policies. These Terms incorporate our Privacy Policy, Returns Policy, and Shipping Policy. If there is a conflict, these Terms control unless we say otherwise in writing.

1.4 Updates. We may update these Terms by posting a revised version with a new “Last Updated” date. Your continued use after changes means you accept the updated Terms.

2) Definitions (Plain-English)

“Account” means your login/profile on the Website. “Products” means Kannaco-branded consumer goods offered for retail sale. “Order Confirmation” means the email or on-screen confirmation showing items accepted for fulfillment. “Business Days” means Monday–Friday excluding U.S. federal holidays.

3) Accounts, Accuracy & Security

3.1 Information. Provide accurate and current information (name, shipping address, contact details, payment method). Keep it updated.

3.2 Security. You are responsible for safeguarding your login credentials and all activity under your Account. Notify us at hello@kannaco.co of any suspected unauthorized use.

3.3 One person per account. Do not share your account or create accounts using false identities.

4) Orders, Acceptance & Availability

4.1 Process. Your order is an offer to buy. We may accept, reject, or limit quantities at our discretion. We accept only when we send an Order Confirmation or ship the Products.

4.2 Accuracy. We strive for accuracy, but errors may occur (e.g., price, availability, descriptions). We may cancel or adjust an order to correct errors and will notify you.

4.3 Limited quantities. Some Products may have purchase limits or be subject to availability or state restrictions.

4.4 Health disclaimer. Our Products are not intended to diagnose, treat, cure, or prevent any disease. Consult your healthcare professional before use, especially if pregnant, nursing, taking medication, or having a medical condition.

5) Pricing, Taxes & Promotions

5.1 Retail pricing. Prices shown are retail and exclude shipping, taxes, and fees unless stated otherwise. Prices may change at any time before acceptance.

5.2 Taxes. Applicable taxes are calculated at checkout based on your delivery address and current tax rules.

5.3 Promotions & coupons. Promotions are subject to terms and may exclude certain Products. Unless stated, promotions cannot be combined or applied to past purchases.

5.4 Gift cards. If offered, gift cards are subject to the posted gift card terms and are not redeemable for cash except where required by law.

6) Payment; Subscriptions

6.1 Payment methods. We accept payment methods shown at checkout. By submitting a payment, you authorize us and our payment processor to charge your selected method for the order total.

6.2 Authorization & verification. Orders are subject to payment authorization and verification, which may delay processing.

6.3 Subscriptions/autoship (if enabled). If you enroll in an autoship plan, you authorize recurring charges until you cancel. We will disclose billing cadence, pricing, and how to cancel in your subscription portal or confirmation emails. Manage or cancel at least one (1) Business Day before the next renewal to avoid the next charge.

6.4 Chargebacks. If you believe there is an error, contact us first at hello@kannaco.co. Unauthorized or invalid chargebacks may result in order cancellation and Account restrictions.

7) Shipping, Delivery & Risk of Loss

7.1 Shipping. We ship to addresses shown at checkout. See our Shipping Policy for carriers, timelines, and fees.

7.2 Title & risk. Title and risk of loss pass to you upon delivery to the address you provide (or upon carrier handoff if you select a third-party pickup/forwarding option).

7.3 Delivery issues. Inspect packages upon delivery. Report visible damage/shortage within 5 Business Days and concealed damage/defects within 10 Business Days so we can assist.

7.4 Age-restricted delivery. Some shipments may require adult signature and age verification.

8) Returns, Refunds & Exchanges

8.1 Policy. Returns and refunds are handled under our Returns Policy.

8.2 RMA. Some returns may require a Return Merchandise Authorization (RMA). Follow the instructions provided by our support team.

8.3 Refund method. Approved refunds are issued to the original payment method or as store credit, as described in our Returns Policy.

9) User Content; Reviews

9.1 Your content. If you post reviews, comments, or other content, you grant Kannaco a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in connection with the Website and our business.

9.2 Rules. Do not post unlawful, misleading, defamatory, or infringing content, or content that includes personal health information of others.

9.3 Moderation. We may moderate, remove, or refuse content that violates these Terms or our guidelines.

10) Intellectual Property

10.1 Ownership. The Website, its content, and all related intellectual property are owned by Kannaco or its licensors and protected by law.

10.2 Limited license. We grant you a limited, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes consistent with these Terms.

10.3 Restrictions. Do not copy, distribute, modify, reverse engineer, or create derivative works from the Website or its content except as allowed by law.

11) Compliance; Hemp-Derived Products

11.1 Your compliance. You are responsible for complying with all applicable laws regarding purchase, possession, and use of hemp-derived products in your jurisdiction.

11.2 No medical use. Do not use Products to treat medical emergencies. Seek professional medical advice for any health-related questions.

12) Privacy & Cookies

Use of the Website is governed by our Privacy Policy, which explains how we collect, use, and share information, and your choices (including cookie controls and opt-outs).

13) Warranties; Disclaimers

13.1 Limited product warranty. Kannaco warrants that Products will materially conform to their labeled specifications at the time of shipment and until the earlier of (a) expiry date or (b) twelve (12) months from shipment, when stored and used as directed.

13.2 Exclusions. The warranty does not cover damage or non-conformity caused by misuse, improper storage, alteration, or use after expiry.

13.3 Sole remedies. Your exclusive remedies for breach of warranty are repair, replacement, or refund as described in our Returns Policy.

13.4 General disclaimers. EXCEPT AS EXPRESSLY STATED, THE WEBSITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” KANNACO DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) KANNACO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; WHERE PROHIBITED, WE LIMIT LIABILITY TO THE MINIMUM EXTENT PERMITTED.

15) Indemnification

You agree to defend, indemnify, and hold harmless Kannaco and its affiliates, officers, directors, employees, and agents from and against claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Website or Products, or your violation of law.

16) Dispute Resolution; Governing Law; Venue

16.1 Governing law. These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws principles.

16.2 Arbitration & class-action waiver. To the fullest extent permitted by law, any dispute arising from or relating to these Terms or your use of the Website or Products will be resolved by binding arbitration on an individual basis under the Consumer Arbitration Rules of the American Arbitration Association (AAA). The seat of arbitration is Johnson County, Kansas, unless the AAA rules require otherwise or both parties agree to remote proceedings. CLASS, COLLECTIVE, OR REPRESENTATIVE ACTIONS ARE NOT PERMITTED. This section does not prevent either party from seeking relief in small-claims court or from seeking injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or data security.

16.3 Opt-out. You may opt out of arbitration within 30 days of creating your Account or first purchasing by emailing hello@kannaco.co with subject “Arbitration Opt-Out” and your name, email, and order number.

17) Site Use; Prohibited Conduct

You agree not to: (a) access the Website other than via our published interfaces; (b) probe, scan, or test systems without authorization; (c) scrape or harvest data except via features we expressly enable; (d) upload malware; (e) interfere with security or operation; or (f) misrepresent your identity or age.

18) Third-Party Services

The Website integrates third-party services (e.g., Shopify, payment processors, carriers, analytics). Their terms and privacy policies apply to their services, and Kannaco is not responsible for them.

19) Notices

20) Miscellaneous

20.1 Independent parties. These Terms do not create a partnership, franchise, or agency relationship.

20.2 Assignment. You may not assign your rights or obligations without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.

20.3 Severability; waiver. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver.

20.4 Entire agreement. These Terms, together with the policies referenced herein, are the entire agreement regarding your retail use of the Website and purchase of Products.

20.5 Headings. Headings are for convenience only and do not affect interpretation.

20.6 Electronic communications; e-signatures. You consent to transact electronically and to receive communications electronically. Electronic signatures and records have the same legal effect as paper versions.
